Christmas tree leads to injury claim being thrown out

A woman from County Clare in Ireland has had a €760,000 injury claim dismissed after she was pictured winning a Christmas tree throwing competition just days after telling doctors she was in debilitating pain.

According to a report in the Irish Independent, Karina Grabska sued RSA Insurance for damages after the car she was a passenger in was hit in 2017 when she was on her way to work in Ennis.

In January 2018, she told doctors she was unable to work due to chronic pain, yet two days later she was photographed winning a Christmas tree throwing contest. The photos were shared widely and later came back to haunt Grabska.

Louise Smith, acting lawyer for the defendants, told Business Insider that their suspicions led to an open source intelligence report being commissioned. “Certainly a photograph as graphic as the one found in this case is unusual,” she said.

“However, our Insurance Fraud team would always thoroughly investigate every claimant online in advance of every case and at this stage we are never too surprised of what we find online.”

Court records show Karina Grabska’s case, being heard at the High Court in Limerick, was dismissed last month.
